1. General Introduction

These Terms of Use govern the conditions, rights, and obligations between Global Connections Group Co. Ltd (hereinafter referred to as “GCG” or the “Company”) and users when accessing, registering an account, submitting information, using forms, content, documents, advisory services, industrial property representation services, document drafting services, or other utilities provided on the GCG website.

By accessing the website, creating an account, submitting forms, placing service orders, making payments, using documents drafted by GCG, or continuing to use the GCG website, users confirm that they have read, understood, and agreed to be bound by these Terms of Use, the Personal Data Protection Policy, Payment Policy, Refund Policy, and other policies published by GCG from time to time.

If users do not agree with any content of these Terms of Use, users are requested to cease accessing and using the website and refrain from submitting any information, data, or service requests to GCG.

2. Definitions and Interpretation

  • GCG means Global Connections Group Co. Ltd, Enterprise Registration Certificate No. 0314879159, an industrial property representation agency licensed by the Intellectual Property Office of Vietnam (IP Vietnam), operating the website, tools, forms, content, services, and related utilities.

  • GCG Website means the website at domain name saigongcg.vn and other domain names, landing pages, applications, tools, online forms, or electronic channels operated by GCG.

  • User means any individual, organization, business, or representative of these entities accessing, using the website, or submitting information to GCG.

  • Customer means a user who requests consultation, industrial property representation, document drafting, service ordering, payment, or enters into a service contract/agreement with GCG.

  • Services mean services provided by GCG, including but not limited to: consultation, registrability searches, drafting and filing applications for registration of trademarks, patents/utility solutions, industrial designs, copyrights; tracking application processing progress at IP Vietnam; renewing and amending protection titles; and other services published on the website.

  • Personal Data means information in the form of symbols, script, digits, images, sounds, or similar formats attached to a specific person or helping identify a specific person.

  • User-Provided Data means all information, documents, data, forms, images, files, content, or instructions entered, uploaded, or submitted via the website, email, registration forms, consultation channels, or other methods by the user.

  • Dossier Drafted by GCG means registration applications, declarations, contracts, documents, or materials prepared by GCG for submission to IP Vietnam or other competent state authorities, based on the customer’s information and instructions.

3. Scope of Application

These Terms of Use apply to:

  • Users accessing the GCG website.

  • Users registering accounts or submitting information on the GCG website.

  • Customers using advisory services, industrial property representation, or fee-based services provided by GCG.

  • Electronic transactions, service requests, quotations, payment confirmations, or service use confirmations arising through the GCG website.

Where a specific service is subject to an individual service contract, quotation, appendix, or specific condition, such documents shall apply concurrently with these Terms of Use. In the event of any inconsistency, the individual service contract shall prevail for that specific service, unless otherwise provided by law.

4. Eligibility and Conditions for Website Use

Users warrant and represent that they have full civil act capacity, representative authority, or lawful authorization to access, submit information, order services, execute agreements, make payments, or conduct transactions on the GCG website.

If the user represents a business, organization, or another individual (e.g., applicant, owner of trademark/patent), the user warrants that they hold full representative authority or a valid power of attorney, and assumes full responsibility for all information, instructions, and documents provided to GCG.

GCG reserves the right to refuse, suspend, or terminate service provision if there are grounds to believe that the user lacks lawful eligibility, provides inaccurate information, or violates these Terms of Use.

5. Scope of Services of GCG

GCG provides the following service groups, depending on the requirements and agreement with each customer:

  • 5.1. Industrial Property Representation; Copyrights and Related Rights: Consultation and representation for registration, registrability/protectability searches, renewal/amendment/assignment of protection titles, registration of copyrights and related rights, in-depth consultation on trade secrets, intellectual property portfolio management, and IP dispute resolution.

  • 5.2. Sustainable Development (ESG) and Green Transition Consulting: ESG/CBAM/ILO compliance consulting, greenhouse gas emission measurement and inventory, ESG risk review and management (supply chain, greenwashing, antitrust).

  • 5.3. Corporate Training, Specialized Workshops, and Trade Promotion: Organizing specialized workshops/forums, in-house corporate training, and business connection activities (exhibitions, trade fairs, B2B matchmaking).

  • 5.4. International Market Research: Organizing overseas field trips, consulting on local business/legal environments, connecting and supporting the execution of memorandums of understanding (MOUs) with foreign partners.

For services under Section 5.1, GCG is not a state agency and does not issue protection titles or grant application approval decisions; registration outcomes depend on the assessment of competent authorities, and GCG does not guarantee application approval. For services under Sections 5.2–5.4, GCG acts as an advisor, organizer, and facilitator; representing customers directly in dealing with third parties is subject to written authorization. Specific business or cooperation outcomes arising from these activities also depend on the goodwill and decisions of the relevant parties.

The specific scope of work, timeline, and fees for each service are specified in the corresponding quotation or service contract.

6. Nature of Content and Limitation of Advice

The content on the GCG website (articles, reference forms, checklists, preliminary advice) is developed based on intellectual property laws and the practical experience of GCG’s team, aiming to help users understand procedures and prepare appropriate dossiers. However, public content on the website is for general reference only and does not substitute for specific legal advice based on the actual file of each customer.

The person signing, confirming, or using the dossier remains ultimately responsible for the accuracy, truthfulness, and legality of the information provided to GCG. In cases where the customer executes a service contract and authorizes GCG to perform industrial property representation procedures, the scope of responsibility, obligations, and commitments of the parties shall be governed by the corresponding service contract—such contract shall take precedence if there are differences with these Terms of Use.

Unless otherwise agreed in a separate written service contract, public content on the website shall not be construed as official legal opinions applicable to a user’s specific case.

7. Information Provided by Users

User-provided information may include: full name, phone number, email address, contact address; applicant/owner information (individual or organization); legal representative or authorized person details; trademarks, logo samples, product/service lists, patent descriptions/industrial designs or related technical documents; legal documents, powers of attorney; payment information, contracts, and service requests.

Users assume full responsibility for the accuracy, completeness, legality, and right of use regarding the information and documents provided to GCG (including rights to trademarks, logos, or content requested for registration). GCG shall not be held liable for dossier rejections, processing delays, or disputes arising from inaccurate, incomplete, or unauthorized information provided by the user, or infringement of third-party rights.

8. Service Ordering and Electronic Contracting

Users may request consultation or order services via the GCG website, email, telephone, or other methods accepted by GCG. Before confirming service usage, users must carefully review: the scope of work performed by GCG, provided information, service fees and official state fees (if any), estimated performance timeline, payment terms, and cancellation/refund conditions.

Confirmation by the user via email, signing a service contract, or making payment shall be deemed an act of transaction confirmation, unless otherwise agreed by the parties.

GCG reserves the right to refuse or cancel service requests if: the provided information is incomplete/unlawful; the request falls outside GCG’s service scope; the user fails to pay or fails to coordinate in providing necessary documents; or the request shows signs of violating the law or infringing third-party rights.

9. Service Prices, Fees, and Payment

Service prices are published on the website, quotations, or service contracts from time to time. Depending on the service, total costs may include: GCG service fees, official state fees payable to IP Vietnam, publication/filing fees, value-added tax (VAT), and additional expenses incurred upon customer request or requirement of competent authorities.

Unless otherwise agreed, GCG will only commence service processing upon receipt of full required information and payment according to the policy of each service package. Users are responsible for making timely and full payments in accordance with GCG’s instructions.

10. Rights and Obligations of GCG

  • Rights of GCG: To operate and update the website and services; to request users to provide/verify necessary information; to refuse or suspend services in case of missing information, non-payment, or signs of legal violation; to temporarily suspend access if system abuse is detected; to store information, dossiers, and transaction history for the period necessary to provide services, resolve complaints, and comply with legal obligations; and to amend the Terms of Use pursuant to Section 24.

  • Obligations of GCG: To publicly publish clear and complete information about the Company, service scope, fees, and related policies; to perform services according to the announced or agreed scope and timeline; to protect personal data in accordance with the published Personal Data Protection Policy; to establish mechanisms for receiving and handling complaints; not to use user information for purposes outside those disclosed, unless agreed upon or permitted by law; and to coordinate with competent state agencies upon lawful request.

11. Rights and Obligations of Users

  • Rights of Users: To be provided with information regarding services, prices, performance scope, and processing timelines prior to confirming service usage; to receive dossiers/documents in accordance with the paid or agreed scope; to request correction of provided information upon detecting errors; to exercise data subject rights in accordance with GCG’s Personal Data Protection Policy; and to request receipt and resolution of complaints.

  • Obligations of Users: To provide complete, accurate, truthful, and lawful information; to be responsible for information and instructions provided; to re-check dossiers and documents drafted by GCG prior to signing, filing, or using them; not to use GCG’s website or services for fraudulent, impersonating, or rights-infringing purposes (including requesting registration of trademarks/works to which they hold no rights); to pay all fees in full and on time; and to coordinate with GCG during service processing.

12. Prohibited Acts

Users shall not: provide false or misleading information; impersonate individuals, organizations, or state agencies; use GCG services to register and establish industrial property rights, copyrights, or related rights while knowing they have no rights or with the intent to misappropriate third-party rights; unlawfully breach, scan, or sabotage the website system; copy or extract data using unauthorized bots/crawlers; infringe intellectual property rights, personal data, or legitimate interests of third parties; or interfere with payment processes or conduct illegal transactions.

13. Personal Data Protection

GCG collects and processes users’ personal data in accordance with the published Personal Data Protection Policy and applicable legal regulations (Law on Personal Data Protection No. 91/2025/QH15 and Decree No. 356/2025/ND-CP), to the extent necessary to: identify and contact users; receive consultation/service requests; draft and file dossiers as requested; process payments and contracts; resolve complaints; and comply with legal obligations.

Users hold data subject rights pursuant to GCG’s Personal Data Protection Policy (right to know, consent/withdraw consent, access, rectify, erase, restrict processing, object…) and may submit requests to info@saigongcg.vn. Users understand that withdrawing consent or requesting data deletion may result in GCG being unable to continue providing part or all of the services (e.g., inability to continue tracking application progress).

14. Data Sharing with Third Parties

GCG may share necessary data with: IP Vietnam, Copyright Office of Vietnam, or other competent state agencies during dossier filing and tracking; technology infrastructure and data storage operators; and professional partners (lawyers, associates) when necessary to execute services under customer authorization. GCG requires data recipients to apply appropriate security measures and process data strictly within authorized purposes.

15. Security and Cybersecurity

GCG applies appropriate technical and managerial measures to safeguard the website, data, and system against unauthorized access, loss, or cyberattacks. Users are responsible for securing their own devices, accounts, and passwords; GCG assumes no liability for damages arising from security breaches on the user’s end.

16. Intellectual Property Rights

All interfaces, trademarks, logos, trade names, content, forms, guidance documents, and other components on the GCG website are owned by or lawfully licensed to GCG. Users may not copy, distribute, commercially exploit, or use GCG’s content outside the permitted scope without prior written consent from GCG.

Regarding trademarks, patents/utility solutions, industrial designs, works, or intellectual property objects that customers request GCG to represent for registration: intellectual property rights to these objects belong to the customer (applicant/owner); GCG acts solely as an advisor and representative for application filing under authorization, and no ownership rights vest in GCG regarding such objects. GCG is permitted to use information and documents provided by customers to the extent necessary to perform services, store files, and comply with legal obligations.

17. Deliverables, Dossiers, and Documents Drafted by GCG

Dossiers, applications, and contracts drafted by GCG are based on information and instructions provided by the customer at the time of drafting. Customers are responsible for reviewing all information prior to signing, filing, or using; and assume full responsibility upon confirming that the dossier content is correct and complete.

GCG assumes no liability for errors in dossiers resulting from inaccurate information provided by the customer, or from changes in regulations/requirements of IP Vietnam occurring after the filing date. Where a service package includes commitments to support dossier supplementation upon IP Vietnam’s request, GCG shall perform such support within the scope and conditions agreed in the service contract.

18. Third-Party Links and Services

The GCG website may contain links to third-party services (e.g., payment gateways, professional consulting partners). GCG assumes no responsibility for content, policies, or disputes arising directly between users and third parties, unless otherwise agreed by GCG in writing.

19. Limitation of Liability

To the maximum extent permitted by applicable law, GCG shall not be liable for: damages arising from inaccurate, incomplete, or unauthorized information provided by users; application rejection, amendment requests, or processing delays by IP Vietnam due to factors beyond GCG’s reasonable control; technical glitches, service disruptions, or force majeure events; or indirect damages, loss of profits, or loss of business opportunities.

If GCG is held liable for compensation under an effective ruling or written agreement, GCG’s total liability shall not exceed the actual service fee paid by the user for the specific service directly causing the damage, unless otherwise provided by law.

20. Indemnification and Release

Users agree to indemnify and hold GCG harmless from any claims, losses, liabilities, or expenses arising from: user’s provision of false or unauthorized information; user’s breach of these Terms of Use or applicable law; or user’s infringement of intellectual property rights or third-party legitimate interests through service requests submitted to GCG.

21. Suspension and Termination of Services

GCG reserves the right to suspend or terminate service provision if: the user breaches the Terms of Use; provides false or fraudulent information; fails to pay or coordinate; or upon request of competent state agencies. Suspension or termination shall not affect obligations incurred prior thereto (payment, confidentiality, data protection).

Submissions should include full name, contact details, file/transaction code (if any), description of the inquiry, and supporting documents. GCG receives, reviews, and responds within a reasonable timeframe depending on the nature of the matter.

23. Force Majeure

GCG shall not be liable for delays or failure to perform obligations if caused by force majeure events (natural disasters, epidemics, system outages at IP Vietnam or third parties, legal policy changes, decisions of state authorities, or events beyond GCG’s reasonable control).

24. Amendments to Terms of Use

GCG reserves the right to amend or supplement these Terms of Use to comply with legal changes or operational needs. Updated versions will be published on the GCG website and take effect from the date of posting. Continued use of the website following updates constitutes acceptance of the revised content.

25. Applicable Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of Vietnam. Any dispute arising shall first be settled through good-faith negotiation. If negotiation fails, disputes shall be submitted to competent state authorities/courts of Vietnam for resolution in accordance with the law.
